دانشگاه گلستان پژوهش‌های تغییرات آب و هوایی 2717-2066 1 2 2020 07 22 Analyze of the legal obligations against climate change from the perspective of international treaties and internal law تحلیلی بر الزامات حقوقی مقابله با تغییرات اقلیمی از منظر معاهدات بین‌المللی و قوانین داخلی 55 78 111123 10.30488/ccr.2020.111123 FA هادی حاج زاده دکترای حقوق عمومی، استادیار گروه حقوق و الهیات، دانشکده علوم انسانی و اجتماعی، دانشگاه گلستان، گرگان، ایران Journal Article 2020 07 29 <span>International environmental law is one of the new branches of international law that created after the international community felt threatened by climate change and among codification numerous international treaties it quickly stabilized itself over other international law.</span><br /><span>In this article, we first briefly analyze the most important international agreements related to climate change, as well as the most important legal measures in the Iranian legal system to protect the environment and reduce greenhouse gas emissions.</span><br /><span>In the next step, the obligations of different countries about climate change are studied and the obligations of various internal institutions are analyzed and in the last stage, the gaps and deficiency of these obligations in international law and internal law of Iran are expressed.</span><br /><span>The findings of this study show that the promotion of the status of environmental treaties to human rights treaties can strengthen the position of these treaties in international law. Also, structural and legal reforms in internal law will lead to the development and promotion of environmental standards in Iran.</span> حقوق بین­المللی محیط زیست، از شاخه­های نوپیدای حقوق بین­الملل است که پس از احساس خطر جامعه جهانی درخصوص تغییرات اقلیمی به وجود آمد و به سرعت با تدوین معاهدات متعدد بین­المللی، جایگاه خود را درمیان سایر موضوعات حقوق بین‌الملل تثبیت نمود. در این مقاله، در ابتدا تحلیلی اجمالی نسبت به مهمترین توافقات بین­المللی مرتبط با تغییرات آب و هوایی، و نیز مهمترین اقدامات قانونی در نظام حقوقی ایران در راستای حفاظت از محیط زیست و کاهش انتشار گازهای گلخانه­ای صورت گرفته است. در گام بعد تعهدات کشورهای مختلف نسبت به مقابله با تغییرات اقلیمی و نیز الزامات نهادهای مختلف داخلی در این موضوع مورد واکاوی قرار گرفته و در آخرین مرحله خلاءها و کاستی­های این الزامات در حقوق بین­الملل و حقوق داخلی ایران، برشمرده شده است. یافته­های این تحقیق نشان می­دهد ارتقاء جایگاه معاهدات زیست محیطی به معاهدات حقوق بشری می­تواند به تقویت جایگاه این معاهدات در حقوق بین­الملل بینجامد. همچنین اصلاحات ساختاری و هنجاری در حقوق داخلی نیز به توسعه و ترویج استاندارهای زیست محیطی در ایران منجر خواهد شد. https://ccr.gu.ac.ir/article_111123_e49274516a27487f894ae956166eb7a4.pdf
